Terms of Service

By using DmBuy you confirm your acceptance of, and agree to be bound by, these Terms of Service. This Agreement takes effect on the date on which you first use the DmBuy application or services.

The contracting party is Voalohany SARLU. DmBuy is a product operated by Voalohany SARLU. Any reference to “we”, “us”, “our”, or “DmBuy” in these Terms refers to Voalohany SARLU.

DmBuy is provided as a Software-as-a-Service (SaaS) subscription with monthly billing, processed by our merchant of record Paddle. Each subscription tier (Free, Starter, Pro) grants a monthly capacity for messages handled by the AI assistant on Facebook Messenger, a maximum number of products that may be stored in the catalog, and the related platform features described on the Pricing page. Custom plans are available on request for merchants with specific volume or compliance needs. Capacity allowances reset every calendar month.

We reserve the right to suspend or terminate access in cases of fraudulent activity, abuse of the service, or breach of these Terms. Where access is terminated for cause, no refund is owed beyond what is set out in our Refund Policy below.

You agree not to use DmBuy to send messages, distribute content, or process customer interactions in any manner that is illegal, deceptive, defamatory, discriminatory, infringing on intellectual property, or that violates the rights of the customers being contacted or the laws of their jurisdiction. You agree to comply with Meta's Platform Terms and Messenger policies on the Facebook pages you connect, including the standard messaging window and consent requirements, and not to use the service to send unsolicited bulk messages or to impersonate any third party.

You are solely responsible for the lawfulness of the product information you upload, for the orders and commitments your AI assistant communicates to your customers, for obtaining any required consent from the customers you interact with, and for the use you make of the conversations and orders captured through the platform.

It is not warranted that DmBuy will meet all your requirements or that its operation will be uninterrupted or error-free. The AI assistant generates responses automatically and may occasionally produce content that is incorrect, incomplete, or out of context; you may take over any conversation manually from the dashboard. DmBuy relies on third-party infrastructure providers (cloud hosting, AI inference, image processing, message delivery) whose availability we cannot guarantee. All express and implied warranties or conditions not stated in this Agreement (including without limitation, loss of profits, loss or corruption of data, business interruption, or loss of contracts), so far as such exclusion or disclaimer is permitted under applicable law, are excluded and expressly disclaimed. This Agreement does not affect your statutory rights.

Voalohany SARLU shall not be liable for any indirect, special or consequential loss, damage, costs, expenses or claims arising out of or in connection with the provision of the DmBuy services. Notwithstanding any contrary clause, in the event Voalohany SARLU is deemed liable to you for breach of this Agreement, our total liability is limited to the amount actually paid by you to Voalohany SARLU for the DmBuy services in the twelve (12) months preceding the event giving rise to the claim.

Voalohany SARLU is not responsible for the content of the product catalog you upload, the responses generated by the AI assistant on your behalf, or the orders captured through Messenger. You retain ownership of your product catalog and of the conversation history that takes place between your AI assistant and your customers, subject to the underlying terms of any third-party service used in the process. You warrant that you have the right to operate a sales channel on the Facebook pages you connect, to interact with the customers who message those pages, and to process their messages and order information through the platform.

As we continue to improve DmBuy and expand our offerings, prices may change. Changes apply to new subscriptions and to renewals; existing subscribers are notified before any change takes effect on their renewal.

This Agreement is governed by the laws of the jurisdiction of Voalohany SARLU's registered office. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Voalohany SARLU as a result of your use of DmBuy services.

We align with the 14-day refund window provided under Paddle's Buyer Terms. Any refund request must be submitted within 14 days of the original purchase date by emailing admin@dimension-labs.xyz.

Given how DmBuy works, plans grant a monthly capacity (number of messages handled by the AI assistant and number of products that may be stored), and a single promotional campaign or seasonal peak can consume that capacity within a short period. We therefore propose pro-rata refunds based on actual consumption, less any non-recoverable third-party variable costs. Non-recoverable costs include, without limitation: AI processing and model token consumption, compute and hosting infrastructure, storage of conversation history and uploaded catalog assets, transactional email costs, and image processing services consumed during the period.

No refund is owed for: requests received more than 14 days after the original purchase date; subscriptions where the entire monthly capacity has already been consumed; termination for cause; or renewals already in their second period or beyond. To request a refund, email admin@dimension-labs.xyz with your Paddle transaction ID. We respond within 5 business days and, where applicable, initiate the refund through Paddle to the original payment method.
